Not all of the workers’ compensation claims that New York residents file are approved. In fact, many claims for workers’ compensation benefits are denied because they lack specific and necessary information. When preparing to file one’s paperwork to seek workers’ compensation it is important that individuals know what they are doing and that they can seek support from attorneys who work in this area of the law.
Timeliness is a major factor that contributes to denied workers’ compensation claims. If a worker does not tell their employer about their work-related accident in a timely fashion then their eventual claim for support may be denied. Similarly, if a worker waits too long to file their claim for support it may be denied for falling too far from the incident that caused the worker’s injuries.
A worker who does not get medical help for a work-related injury may see their request for workers’ compensation denied, as may a worker who suffers an injury that is not in any way related to their job. Some injuries that happen during working hours will not be considered related to the workers’ employment and therefore are not covered by workers’ compensation.
Individuals who get hurt while doing their jobs should be prepared to explain and provide facts about what happened to them and why they are entitled to workers’ compensation support. This post does not provide readers with any legal advice as individual workers’ compensation cases must be evaluated on their own. More help with this and other workers’ compensation topics may be sought from attorneys who work in this field.
