Denied disability claim? It's not the end of the road for you

When New York readers find that they are unable to work due to a medical condition, it is both frustrating and overwhelming. For these individuals, it is possible that they could be eligible for certain benefits through the Social Security Administration. However, actually obtaining these benefits is rather complicated, and some first-time applications come back denied.

If you attempted to seek benefits yet received notice of a denial, this may feel like a setback. While it is a discouraging development, it is not the end of the road for you. In fact, you could have grounds to appeal this decision and continue to fight for the Social Security disability benefits you deserve. However, when navigating the appeals process, you may find it beneficial to secure guidance as you do so.

You don't have to stop fighting

After receiving a notice of a denial, you may request a reconsideration of your claim. As you prepare for this next step, it can be helpful to understand why your claim came back denied in the first place. Common reasons for a disability claim denial include the following:

  • The proof provided did not exhibit the severity of the claimant's condition.
  • There is no proof that the disability will last for a period of at least 12 months.
  • The disability is the result of drug use or alcohol abuse.
  • The claimant is capable of performing his or her regular job duties.
  • There was not enough medical evidence included in the claim.
  • The claimant was not cooperative and did not follow instructions for prescribed medical treatment.

Once you understand the reason for your denial, you will be better prepared to continue to fight for disability benefits. When you request a reconsideration of your claim, you will be able to present evidence to counter the objections to your original claim. One of the most effective ways to do this is by presenting new medical evidence, such as laboratory results, notes from your doctor and a complete medical history.

Seeking and securing the support you deserve

The Social Security Disability claims process can be complicated, but you do not have to deal with the challenges ahead on your own. A denial is not the end of the road for you, but you still have a good chance of eventually obtaining a positive outcome to your case.

If you plan to request a reconsideration of your denied disability claim, you would be wise to start by seeking a complete evaluation of your case in order to understand the legal options available to you.
