Chiropractic & Workers’ Compensation

What is Chiropractic?

Chiropractic is literally "hands-on" treatment, the aim of which is to restore balance and proper alignment to the body. The chiropractor applies techniques of spinal manipulation to correct misalignments, or "subluxations",that have been caused by trauma, or by the unfortunate variety of wear-and-tear that comes with a physically demanding job, or even simply with time and everyday life.

For many chiropractors, treatment is not limited to manipulation, but may also include nutritional advice, training in the proper way to lift, carry, and haul, and other non-nutritional medicinal, holistically inclined therapies.

What is a Chiropractor?

A Chiropractor in New York State must undergo a rigorous education in chiropractic philosophy, history, and treatment techniques, and must also be thoroughly grounded in anatomy and physiology. Following that, he or she must become licensed by the State, by demonstrating a high level of proficiency on a demanding test.

May I see a Chiropractor for my Workers' Compensation Case?

In New York State, chiropractic treatment for a worker's compensation injury is treated much the same as orthopedic or neurological treatment. If you have an accident, or if the particular physical stresses of your job over time cause you to suffer pain and/or limitations of use of your back or neck, you may visit a chiropractor to find out what is wrong. If you require chiropractic treatment, you should immediately see your chiropractor and have him/her contact your workers compensation insurance carrier. Your Chiropractor will file reports with the Workers' Compensation Board and your insurance company. If you choose to hire an Attorney or Licensed Representative, your Chiropractor should submit your report to him or her as well.

Must I see a Chiropractor if I injure my neck or back?

The Workers' Compensation Law seeks to serve you, the injured worker. Therefore, although you may be treated by a chiropractor, you are not obliged to. If you require treatment for a work-related accident or medical condition, you may choose to be treated by any doctor capable of treating your particular condition. Your doctor should be coded by the Workers Compensation Board.

Must I pay the Chiropractor out of my pocket?

Because Workers' Compensation seeks to serve the injured worker, it recognizes that you might not be able to pay for the treatment you require-especially if you are not able to work because of your condition. Therefore, you may be treated by a Chiropractor for a work-related condition, without having to pay for that treatment out of your pocket. Only if the insurance company fights your case-and only if it wins-will you be responsible for the outstanding bills.

How can I find a Chiropractor familiar with Workers' Compensation?

Many people who wish to be treated by a Chiropractor ask their family, friends, coworkers, and doctors if they have had an experience with a chiropractor whose work they can recommend. You may also contact the Workers' Compensation Board at 1-800-877-1373.
